When debt starts piling up, it can be extremely stressful.  It can be hard to know where to turn to for help and support during the bankruptcy process, as your options may seem limited. That’s where a bankruptcy advocate can be helpful. Bankruptcy advocates can be useful in dealing with pushy creditors or debt collectors while providing support and advice through the debt process. Their main role is to support you and keep your best interests at heart, which can prove useful when you’re dealing with bankruptcy.

If you’re interested in the services of an advocate but aren’t quite sure about what they can provide you, read on below.

What is bankruptcy?

Bankruptcy can also be known as voluntary or involuntary bankruptcy. Voluntary bankruptcy is when you legally declare that you cannot pay your off your debts yourself, using a form that you would fill in.

Involuntary bankruptcy is when a creditor applies to have you become bankrupt. In order to be declared bankrupt involuntary, creditors may apply to bankrupt you through the Federal Court of Australia, with what is called a creditor’s petition. This would be lodged through the court along with other documents.

Once you have been declared bankrupt, you can nominate a trustee, who will manage your finances. In most cases, if you choose not to nominate a trustee, the Australian Financial Security Authority will appoint one on your behalf.

Generally, you will be classified as bankrupt for three years and one day, and your bankruptcy will be publicly registered on the National Personal Insolvency Index. In most cases, after registering bankruptcy you will be released from most of your debts.

If you have secured debts such as a car loan or a home loan, you will most likely still need to make payments towards them. If you are unable to make these payments, it’s possible that your house or car could be repossessed by the bank. In most cases, there is no fee for applying for bankruptcy.
